Guru suing PepsiCo for $15M
Guru Organic Energy Corp says it has filed a lawsuit in the Ontario Superior Court of Justice, seeking $15 million in damages from PepsiCo.
What Guru claims
Guru alleges Pepsi breached its contract and failed to act in good faith. The company is also asking the court to:
- Recover profits Pepsi earned from the "Rockstar Island Bliss" product.
- Collect $164,753 in unpaid invoices.
- Award any additional relief the court considers appropriate.
Pepsi files counterclaim
Pepsi has filed its own claim in the same court, seeking about $4.4 million tied to payments after the company ended their agreement. Guru says it will fully contest Pepsi's claim.
Guru noted that even if the court rules in Pepsi's favour, any potential payments are already accounted for in its October 31, 2025 financial statements.
Carl Goyette, President and Chief Executive Officer of GURU, commented:
“When we entered into our agreement with Pepsi’s Canadian distribution arm in 2021, we did so in good faith and invested significantly in the partnership. Our transition back to direct distribution, which required significant effort and investment, delivered three consecutive quarters of positive Adjusted EBITDA and a record Q1 performance, demonstrating both the strength of the GURU brand and the value that was being held back under the former distribution arrangement," said Carl Goyette, president and chief executive officer of GURU. "Filing this claim is a matter of defending shareholder value on a set of issues we have attempted to resolve privately. Our focus and our capital remain on expanding distribution, advancing our Zero Sugar pipeline, and executing against the priorities we set out in our March 12 Q1 release.”
